It ain’t your mamma and papa’s America anymore. The Bill of Rights are on life support and the prognosis is not good. Rights to life, liberty, and property are being systematically shredded. I think one of the reasons many Americans had no interest in the debate about the Terri Schiavo case, or erroneously considered the Schiavo ‘life’ case an invasion by the government into personal affairs and wanted no part of the debate, is because most people believe a situation like that would never happen to them. This and an ignorance of the Constitution. If Terri Schiavo could speak to us today, I wonder if she would say that she had consented to being starved to death if diagnosed as being in a PVS. Liberty has been under assault for a long time also. The latest ruling by the SC regarding property rights seems to have created a bigger stir among the public. I believe this is because the direct affect is much more likely on the people. If you own property, as most people eventually do, and you have a location of interest to an entity with money and political influence, then you are at risk. This ruling affects many of people. To those who say the judiciary is not activist I say: yea right.

    I hate to disagree with Denis, but I just remember the details of an autopsy showing that Terri Schiavo, God Rest Her Soul, was never going to be able to speak or even think again. Conservatives undermined their states rights and anti-judicial activism agenda by trying to take the case to the supreme court to overturn previous case law (spousal jurisdiction). What a mess!

    I don’t view eminent domain as a constitutional crisis because states still have jurisdiction to control and limit city government’s ability to seize private property. In some ways, I would be willing to agree with the court’s decision from a perspective of state’s rights. On the other hand, this hasn’t shut the door for FEDERAL seizures which has been going on for some time when it comes to federal park managements seizing state land. Now THAT’S a cat that needs to be put back into the bag!

    thanks for the intelligent response. by the way, I am in agreement with you regarding emminent domain. the courts however are breeding resentment within (some of) the citizenry with these decisions.
