Bosquete was convicted of rape and sent to prison after being incorrectly identified by the so-called “victim” (who may or may not have actually been raped).
Understanding that the DNA tests available today were not available at the time of the incident, it would be difficult to prove that the D.A. involved was guilty of malfeasance or misconduct in prosecuting Bosquete.
The state certainly owes Bosquete for wrongfully convicting and imprisoning him for a crime that he did not commit, based upon more recent DNA tests.
Unfortunately simply paying Bosquete a large sum of money is unlikely to discourage malicious or even accidental prosecution of men, based on false identification of rape suspects, unless such acts have been proven to have happened on a widespread basis.
And even then, all bets would be off with respect to affording men protection against whimsical claims of rape in our vaginized society.
Until false rape accusations are made a felony crime, and prosecuted with the same vigor that rape accusations are,…………
………..and “rape shield laws” overturned so that alleged rape victims’ pasts are no longer sacrosanct,
there is minimal risk to those insane, vengeful, or attention-seeking women whose accounts of fictitious rapes have been used to wage gender war, as well as minimal risk to the district attorneys and law enforcement officials who wage war on men on those womens’ behalf as well as for their own gain.
Then there is the whole issue of believing a woman’s word that she was actually raped by the man or men she identifies.
Militant feminazis spew considerable doses of venom at any mention that some so-called “rape victims” might actually be lying, when research has indicated otherwise.
Until our society stops automatically conferring “victim status” on women while simultaneously hiding their identities and broadcasting the identities of the accused, men will continue to face injustice at the hands of unscrupulous, deranged, or vengeful women and incompetent or politically motivated district attorneys, as seems to be the case for Crystal Gail Mangum and D.A. Nilfong of Durham, N.C. notoriety.
The accuser ought to serve the sentence in prison; however, there is little or no consequence today for a woman to falsely accuse men.
I guess it would be foolish to expect the state to make Bosquete “whole” considering it was the state who took away 13 years of his life. There needs to be a cost to the state for this. Otherwise, what incentive is there for the state to “get it right”? If the state can simply find someone to blame (such as for political reasons in an election season as with the D.A.in the Duke rape case)to show they are aggressively enforcing the law then all men everywhere are at risk of a false accusation. Where is justice for Bosquete?
Bosquete has served about 13 years of his sentence.
Sheriff’s spokeswoman Becky Herrin said nobody else will be sought in the case because the statute of limitations has expired.
Officials haven’t released the name of the victim, nor would they say whether she’s been notified that Bosquete wasn’t her attacker.
