This is still no biggie. Even if the GOP retains control of the Senate, the Dems have the House. That means Bush’s agenda gets watered down in any scenario. The only advantage of a GOP-controlled Senate is confirmations — of cabinet nominees, judicial nominees, Supreme Court nominees — and treaty ratifications (which are less partisan). I doubt an Alito-style conservative is going to fare much better in a 49-51 Congress than a 50-50 Congress, should the opportunity to nominate one arise.
