Rape is a terrible crime and those who commit it deserve all of the sanctions the law requires to be imposed upon them.
Same goes for false accusation of rape.
Belief that the lynching victim committed rape is the motivation for about 70% of the lynchings known to have taken place in the United States throughout our history. This is true for both the black men who have been lynched and the white men who have been lynched.
Thus a woman was capable of committing murder by making such a false accusation.
Thus while it is important that we enforce our criminal statutes, it is equally important that we enforce the rights of the accused to DEFEND the charges.
The Bill of Rights, like the Ten Commandments, are not the Ten Suggestions.
As much sympathy as we have for genuine rape victims and genuine child victims, the right to confront the accuser, meaning the right to cross examine under oath in front of the trier of fact, is VITAL to the right to due process of law.
And so is the Hearsay Rule.
For my commentary on when a state supreme court fails to enforce these basic due process rights:

"California now requires that jurors be explicitly told that a rape conviction can be based on the accuser’s testimony alone, without corroboration. "

Hasta la Vista. And people thought Arnie was going to save the day. Hah! All he's done is Terminate justice.

Hey Judge, that woman stole my value. Whaddya mean, prove it.

The truly appalling thing is the amazing self-righteousness of American women on issues like this. I've gotten to the point where I won't even discuss these issues with women and it's rapidly getting to the point where I don't want to talk to women at all except when I have to.
