Some folks may not have heard of the rape case being prosecuted against three Duke University Lacrosse players. More people may not have been paying attention to the way the case seems to be falling to pieces, yet the prosecutor, Mike Nifong, continues to prosecute.
Doug Powers has a proposal:
In the meantime, here’s my modest proposal, and one that would apply in general to any would-be out-of-control prosecutor: Let it be known going in that should solid evidence be found that a prosecutor pursued a false or grossly misleading case against any citizen, said prosecutor should be subject to at least the same sentence they sought to impose on the defendant.
Interestingly enough, Jewish law calls for that, in the case of a false witness. If someone is found guilty of bearing false witness, he or she is subject to the penalty the defendant would have received, had the testimony been believed.

Sounds like a sound consequence. At the very least, it would make smart lawyers think twice before prosecuting frivolous cases, and at best it would put stupid ambulance chasers behind bars where they belong. Either way, the impact on the overburdened legal system will eventually settle down to a more reasonable level.

Get the Building and Construction industry Unions behind it. Just think of all the jobs, building womens’ and lawyers’ prisons. At least 5 in every state. Could be just the economic stimulator we need.
