The man falsely accused of rape was not innocent as he was having sex with a married woman.
Texas may be a good place to live. If the same situation occurred a few thousand mile away in liberal Chicago, I suspect the wife would have been the victim and the husband in prison.

I believe, at law, she would at least be an accessory before the fact, that is if her husband were considered the killer. But since he is not the suspect, she is the instigator or solicitor of murder — she goaded or stimulated her husband to kill the man so as to protect her.
