In the case of legally “fit parents” parents, no such authority exist. Both parents have equal parental rights and the legal principles of injunctions must apply, ie. Minimal restrictions on the parties to resolve the dispute. The only question for the state would be the question of fitness of parents and the rules applicable to parental termination would apply. The state would leave this 50:50 daily exchange physical custody until the parties offer a better mutually agreed custody arrangement.
