My Column on the ‘Women’s Equality Amendment’ in Philadelphia Daily News

My co-authored column A misguided ERA-substitute (Philadelphia Daily News, 6/7/07) reiterates my belief that it is wrong for the backers of the new Equal Rights Amendment to change the name to the “Women’s Equality Amendment.” 

As my column explains, many of the injustices based on gender today work against men and fathers. The ERA, which seeks to end any bias or discrimination based on sex, is appropriate. The WEA, which ignores many of the worst gender-based injustices, is not.

    There are phrases in the Language that are oxymoronic. Court of Justice, for example. Women’s Equality, is another. Police Protection? Honest Politician? The moment they are heard, the internal contadictions start cog wheels turning in the brain. The language is crushed between mill stones.

    Legislation to achieve women’s equality is akin to putting out fires with a can of petrol.

    I ditto DW2G. Please name one bona fide situation in which American women are dicriminated against based on gender. Good luck with that.

    Now, start naming bona fide situations where there is discrimination against males. I could spend all day doing that, and I’m sure I’d still miss some. Here is just one item that would need to be part of an EQUAL Rights Amendment:

    1. As it is now for mothers, when a father states the he is “in fear” of the mother of his children, police will forcibly remove the mother from the home, the mother shall be presumed to be guilty of “domestic violence”, she shall be restrained from going anywhere near the father and the children or face additional sanctions, and she must prove her innocence in court at her own expense one or two months later if she ever hopes to see her children again. Any attempt to see her children during that time will result in further charges and prosecution against her, as will failure on her part to financially support the father and the children from that day forward.

    Putting the name back to “Equal Rights Amendment” is not enough. We must also ensure the elimination of the often concealed second section of the amendment. This section directs congress to pass laws to “interpret” the very simple wording of the Amendment. This is completely unnecessary giving the elegantly simple wording of the amendment. The real reason for the second section is to ensure the primary requirement of the first section is never achieved.
