Appeals Court Blocks Visit Between Husband-Killer Mary Winkler and Her Children

Background: Mary Winkler–who shot her husband in the back and then refused to aid him or call 911 as he slowly bled to death for 20 minutes–walked away a free woman last month after serving a farcically brief “sentence” for her crimes. She is currently in a custody battle with Matthew Winkler’s parents, who have been raising their three daughters for the last 18 months.

The Winklers seek to terminate Mary Winkler’s parental rights and adopt the girls. I support their position. Last week Mary Winkler was granted supervised visits with her daughters–an important step towards getting custody of them.

A Tennessee appeals court yesterday blocked a supervised visit between Mary Winkler and her children, in response to an appeals by Dan and Diane Winkler, the children’s grandparents. The Associated Press story is below.

JACKSON, Tenn. (AP) — An appeals court Friday blocked a supervised visit between a woman convicted of killing her minister-husband and their children.

The court issued a stay against the Saturday visit after a last-minute application from the children’s paternal grandparents, who have had temporary custody of the three young girls since Mary Winkler went to jail after the March 2006 shotgun shooting.

Winkler, 33, was convicted of voluntary manslaughter in April for shooting Church of Christ minister Matthew Winkler at their residence in Selmer.

“It’s very devastating to Mary and I’m sure to the children,” said Winkler’s attorney, Kay Farese Turner.

The stay is only temporary pending an investigation of Dan and Diane Winkler’s accusations that the judge who originally granted the visit ruled erroneously, Turner said.

A call to the office of William R. Neese, Dan and Diane Winkler’s custody attorney, late Friday was not immediately returned.

Winkler has said the grandparents will not let her see or talk to her children, who are now 10, 8 and 2 years old. They are seeking to terminate her parental rights and adopt the children while Winkler is attempting to regain custody.

Her former parents-in-law also have filed a $2 million wrongful death lawsuit against her.

    Thank goodness that Winkler’s children HAVE paternal grandparents….. since our beloved courts believe that even a murderous bitch like Winkler ought to gain custody of children.

    Matthew Winkler received a sick parody of justice through his wife’s slap-on-the-wrist for killing him.

    No doubt he would have wanted his children to be raised by someone other than his killer.

    It’s not NEARLY devastating enough to “Mary”…… and I AM CERTAIN that the children will adapt to the loss of their mother through the love and care of their grandparents.

    And perhaps the court ought to have considered more carefully, before awarding Winkler a slap-on-the-wrist just how devastating the loss of their father was to those children.

    Of course it was not devastating for their father to be murdered and for their mother to watch him die without calling for help.

    According to Tenn. law, she has been covicted of a crime for which her parental rights should be terminated.

    I would however allow her parents, the childrens grandparents to have supervised visits with their grandchildren. Supervised mainly to make sure they did not allow their mother to see them.

    Remember the orthodontist bitch who ran her husbands over with her mercedes. I think it was four times actually while HIS bioological daughter who was in the car with her begged the pig to stop. She somehow, even despite oprey windbag having her on the tv show, is serving time for murder. She got custody of their biological children even tho she’s serving time. No doubt when the parole borad meets they’ll be sure to grant g=her early release, no doubt “for the children”.

    The fact she’s out (Winkler) means those kids days are numbered. She’ll get them sure as rain. The grandparents will then be stricken from their lives for daring to “obstruct mummy”, and “mummy don’t forget”. Better they they bolt the doors and make sure this bitch don’t come a callin.

    It’s called justice, amerikan style. Even a murdering bitch is better “for the children” then two loving, ahem, NON MURDERING grandparents.

    Well, at least they tried, for however long they held the murdering slut at bay the kids had some real love in their lives. They may remember it or not but rest assured when the murdering bitch gets them the indocrination begins: “your father was a ______” (fill in the blank).

    It never ceases to amaze me… the courts that is… You always hear about the “it’s about the children….. it’s for the children”…. Yet, in this case, it ISN’T about the children. Allowing contact with these kids can only have one, and only one possible affect…. and it aint good.

    TMOTS, it’s NEVER about the children. If it was about the children, school busses would have seat belts, and courts would require that joint physical and legal custody be the rule, and mothers would be inprisoned for violating the same court order that fathers are inprisoned for.

    It’s not about children. Follow the money.

    Soon the government will give her what she wants. No different than if she divorced her husband.

    If America desired what was best for children, then divorce would be more difficult obtain. Strength and excellence comes from family.

    The war of words continues. Notice how the terms used are the gentlest possible (and most blame diffusing) when talking about the slaying.

    ~should be: a woman who killed her minister husband.
    Stating she was only convicted of it sounds like the author believes her to be innocent. I’ve seen numerous articles on Scott Peterson. After the verdict it was always written in a form of no-doubt verbiage.

    Here: who have had temporary custody of the three young girls since Mary Winkler went to jail after the March 2006 shotgun shooting.
    ~notice that it MUST be pointed out that custody is temporary (isn’t that yet to be determined?),
    ~notice also that they call it a SHOOTING. If the genders were reversed it would be a SLAYING.

    I wouldn’t be surprised if the grandparents were drilling it into the childrens’ heads that their mother is dangerous and killed daddy.

    I wouldn’t be surprised if the first high-profile use of parental alienation (in courts) were to benefit a woman who killed her husband. Would NOW still be saying PAS is a hoax if Mary Winkler used the claim to get her children back?

    Just to clarify: I think Mathew’s parents would be justified in using these tactics to safeguard the children.

    I just wouldn’t be surprised in the slightest if somehow feminists started jumping up & down and waving their arms about child manipulation. One of the few times manipulation of the children is probably good (keeping them safe from a psycho parent who murdered the other parent) feminsts would say is bad, but the millions of women that leave marriages because they’re bored, and turn the kids against daddy only for spite’s sack is a-okay.

    Watch, wait, and see! I bet Mary Winkler will accuse the grandparents of manipulating the children!

    Unfortunately, Tennessee courts do not pass custodial decisions on the “best interests of the children.”
    They are based on “the doctrine of the superior rights of parents.”
    I have serious concerns about the children being returned to a woman who has such poor impulse control that she shoots her husband while her children are just feet away.
    Nonetheless, the courts might rule in Mary’s favor. Another travesty of justice in this case.
