Nifong and HRES 590

The Nifonging of the three lacrosse players from Duke University did not rise out of a vacuum. Rather, it was the product of two systemic problems in America, the tendency amongst many prosecutors and judges to replace the concern for justice with the concern for self-promotion and career advancement, and, in cases of certain politically charged crimes, anti-male bias.

Illustrative of the bias, on September 25, 2007, the U.S. House of Representatives passed a resolution on domestic violence, HRES 590, that stereotypes men as wife-beaters. A thorough analysis of the resolution by RADAR (Respecting Accuracy in Domestic Abuse Reporting) found that 18 of its 23 statements are either misleading or simply wrong. Two in particular unfairly smear fathers:

  • “Whereas 40 to 60 percent of men who abuse women also abuse children.”
  • “Whereas according to one study, during court ordered visitation, five percent of abusive fathers threaten to kill their spouses, 34 percent of abusive fathers threaten to kidnap their children, and 25 percent of abusive fathers threaten to physically hurt their children.”

With the passage of HRES 590, savvy prosecutors and judges will clearly perceive the political winds as blowing against men, as they have been for some time.

In the April 24, 1995 issue of the New Jersey Law Journal, a judicial training program on domestic violence caught on tape was recounted. The program openly encouraged judges to ignore constitutional considerations in granting temporary restraining orders. “Your job is not to become concerned about all the constitutional rights of the man that you’re violating as you grant a restraining order,” they were advised. “Throw him out on the street, give him the clothes on his back, and tell him, ‘See ya’ around.’” Attendees were given additional advice: “If you’ve got any hint whatsoever there’s a problem, sign the TRO. Don’t take the chance;” “Quite frankly, the standard really is by a preponderance of credible evidence. That’s what the law is. But what he’s saying to ya, ‘Don’t make that mistake at three o’clock in the morning.’ You may be a little tired. Err on the side of being cautious;” and “So don’t get callous about the fact that these people are pestering you again. You know, grant the restraining order. It’ll be the one time that you don’t grant the restraining order that you’ll be tomorrow’s headlines.”

Similarly, in “Criminal Law Comes Home,” Harvard Law School professor Jeannie Suk reveals that in Manhattan, the vast majority of “domestic violence” cases do not involve serious physical injury, and many do not involve any physical injury. But “[e]ven as the ‘violence’ of DV has been defined down,” to the point where harassment is considered violent, these cases “trigger application of a ‘mandatory domestic violence protocol’ different from other crimes.” As Suk explains, “[t]he uniform application of a mandatory protocol in every case represents the prosecutorial response to a paradigm story in which DV victims can turn into murder victims overnight. In the oral culture of a prosecutor’s office, a misdemeanor DV defendant has the potential to turn out to be an O.J. Simpson.” Indeed, reminiscent of the warnings given to the New Jersey judges, “[r]ookie prosecutors are warned that their DV misdemeanors are the cases that could get their names in the newspaper for failure to prevent something serious.” Consequently, “every case is treated as a potential prelude to murder.”

In light of the legal culture that has developed around the issue of domestic violence, it is no wonder that rape cases are sometimes prosecuted despite the absence of good evidence to support them. The actions of DA Nifong in the Duke rape case should not be viewed as the actions of a “rogue prosecutor,” but as a predictable result of years of prosecutors being encouraged to zealously prosecute crimes involving women, and of judges and prosecutors being discouraged to respect the due process rights of men. What makes the Duke case unique is defendants with the resources to vigorously and successfully defend themselves. Can anyone doubt that there are innocent men in prison right now who simply did not have the ability to oppose a rush to judgment?

Legislatures must tell the executive and judicial branches that Nifonging is unacceptable. Repealing HRES 590 would be a good start.

    HRES 590 is jam-packed with half-truths, distortions, and lies:

    We did succeed in stopping the bill from being debated by the House Education and Labor Committee. But it appears the House leadership did an end-run on us, taking the bill out of committee directly to the House floor. Not only that, the leadership cut the debate short, requiring a two-thirds vote for a voice vote.

    Yes, it was a disgraceful short-circuiting of the democratic process, but that’s what they did. So we have to learn from the experience and plan to do much better next time.

    What lesson did we learn? That stopping a flawed bill like this requires a MASSIVE outpouring of voter discontent. To do that, we need to substantially increase the number of people signed on to the RADAR E-lert list.

    So here’s what we’re asking you to do –

    Think of all the listservs and organizations you belong to that are concerned about the destructive effects of VAWA. Pass along this Alert to those groups with this simple message:

    Do it now. We must not allow a repeat of the HRES 590 disgrace.

    Let’s face it: Nobody can effectively use those stupid websites where one has to pretend to be a constituent by putting in a valid zip code etc. One has to use a Broadcast Email program like Easy Mail Merge which is easy to find online.

    Who is doing a Press Release on this?

    Having said all that: This was probably the bill that just authorized $1Million in federal funds to the feminist Tahirih Justice Center for their fraudulent campaign to help socalled “Mail Order Brides” who are foreign women who do not want their help, but want to meet the American men who plan to put the directors of the Tahirih Justice Center in jail for fraud.

    But these guys are busy executives and expats.

    Is there anyone reading this who can walk into a federal courthouse (pro se without a lawyer) and demand that Domestic Violence be declared by the Supreme Court as something the US Congress has no power over?

    If I did not have my current job but was only getting $4K per month to be a Mens Rights Activist, I would be involved in several federal challenges now, without a lawyer.

    The problem with lawyers is that they are afraid to do what Cicero did in ancient Rome, which was to win cases by declaring the Senate and Judiciary corrupt and daring the court to say otherwise.

    I know there are plenty of conservative and libertarian federal judges out there who would put the kabosh on federal funding for domestic violence organizations.

    Who out there will volunteer to put the kabosh on this via a federal challenge by walking into a federal courthouse tomorrow and getting a trial date that we can all help prepare for?

    This is a further tightening of the noose around ALL men. It was and is a juggernaut going back decades. Our enemies, having seen increasing activism of men and father’s over the past few years have multiplied their efforts. They come from a position of strength that was built up over decades. We are only now getting on our feet. They have the numbers and influence where it counts: in the U.S. Congress, legislative houses across the land, and virtually every family court in the land. They have access. We have emails. It anyone really believes fighting this force with facts, the truth, and simple right and wrong then they are naive. The pols don’t bother to question the facts behind legislation they approve. They often do not even write the bill that they approve. Their constituents do. WE NEED VISIBLE AND VOCAL NUMBERS to make the politicians take notice. college activist is right. Also: Keep up the marriage strike. Live life for yourself. Turn your backs on American women. Travel the world. Let the institution of marriage collapse. Let the country be overrun by alienated boys and men. Let the women have the good jobs. Let them pay most of the taxes that will be needed to deal with a culture that has collapsed. Let all the burden of trying to keep a collapsing society functional fall onto the women. As an individual single man find your dreams in a better place.

    Our handfull of men cannot fight this juggernaut by ourselves, and the media elite cannot see whats coming!!

    Jim Peterson, you’re a real comedian! Do you understand what a Resolution is and what a Joint Resolution is? May I be so bold as to suggest a Civics class?

    Michael Robinson in California, the only “MRA” lobbyist in the United States that I am aware of, pounds the Sacramento marble floors for less than half that $4k you dream of while trying to support a family with active kids. He is successful but can only be so effective against the overwhelming number of issues. Expect him to bag it, move on to Kraft Foods and get Arnold sign a proclamation declaring August “California Mayonnaise month.” What a friggin waste…

    The only people sending CAF&C money is the little guy, not the wealthy. No, they prefer going into Family Court time and time again only to get their butt kicked again and again and pay HUGE attorney’s fees rather than be part of the solution.

    Don’t bother contacting the legislators. It’s done and over with and no way in hell are any of the 395 interested in re-visiting this. The damage has been done and it is irreversible.

    The setback for men trying to get meaningful access to DV support is monstrous as now all that nonsense is built into a House Resolution, so every legislator, DA, and cop everywhere has just been totally vindicated in their horrid anti-men/husbands/fathers policies.

    I have no bones to pick with RADAR but they are clearly NOT on radar for even ONE legislator. A defeat of this magnitude and significance calls for the resignation of those running RADAR. At 395 to zero, their failure on the floor vote is a complete and total embarrassment. Those in charge of this fiasco need to be held accountable.

    Change will only come when we have a large portion of the male population that is hostile to the feminist state and hostile to the anti-male culture, and who also live their daily lives in accordance with this hostility. My message is for all males of every race, religion, and culture. Recognize the vast influence of feminism on this culture and live in a way that minimizes this influence on your own life. The change will result from a bottom-up cultural shift. A shift where the newly enlightened mass of males will drive politics. Not the other way around. But that requires getting the word out.
