This Takes Being a Greedy Ex to a Whole New Level

“A man who was pardoned after spending 18 years behind bars for a rape he didn’t commit has been sued for back child support.

“Dwayne Allen Dail, 39, was cleared in August of the 1987 rape of a 12-year-old Goldsboro girl. The girl identified him as her attacker and hair found at the scene was similar to his. But DNA evidence found on a fragment of the girl’s nightgown years after the trial proved Dail wasn’t involved in the attack.

“Gov. Mike Easley pardoned Dail two weeks ago, making him eligible to receive $360,000 from the state – $20,000 for each year he spent in prison.“Dail, who now lives in Florida, was served Tuesday with a lawsuit by Lorraine Michaels, the mother of his son, who is seeking back child support. The suit does not specify how much money she wants, as is normal in North Carolina, but asks a ‘reasonable sum for the care and maintenance of the minor child.’ Dail did not provide while he was in prison.

“Dail said he was devastated by the suit. He said his son recently moved to Florida to live with him.

“Michaels’ attorney, Sarah Heekin, said she filed court papers last week.

“Heekin is in the same law office as Don Strickland, the former Wayne County assistant district attorney who prosecuted Dail for rape.”

The above is from Wrongly Convicted Man Sued for Child Support (10/23/07) from WRAL in North Carolina.  A few comments and questions:

1) The man’s son–who is 17 and was born after he went to prison–is now living with him–why should Dail (pictured) owe the ex child support?

2) ”Dail did not provide while he was in prison”–what a bastard. While he was behind bars for 18 years for a crime he didn’t commit, he didn’t pay out part of the zero income he earned in prison to pay child support.

3) Lorraine Michaels takes being a greedy, self-centered ex to a new level. Does she really think she deserves a cut of the chicken feed $20,000 a year Dail got for being wrongly imprisoned?

A few other facts about the case:

1) According to another WRAL article:

“[Before the trial] prosecutors offered Dail a plea deal under which he would plead no contest to charges of taking indecent liberties with a minor and receive only three years’ probation in return…

“During the trial’s closing arguments, [prosecutor] Strickland remarked on Dail’s remarkable confidence in his innocence in the face of such serious charges, Dail said.

“After being sentenced to two life sentences, plus 18 years, Dail continued to maintain his innocence from behind bars. His exoneration justified all that confidence, Dail said at his release…

“In the future, Dail said he may write a book or go to college. He’s also enjoying reconnecting with his 17-year-old son Chris Michaels, who was born after he went to prison.

“‘He’s grown up only seeing his father in prison, and that’s a terrible way for a kid to grow up,’ Dail said.

“‘It’s over, so we can now start spending more time together and getting to know each other a lot better,’ Michaels said.”

    I don’t think court judgments are considered “income” when determining child support amounts. They are much like indemnity payments, like insurance policies, which are not designed to propduce income, but rather are desgined to put you back into the financial position you were in prior to your loss.

    So in theory, her claim on his money should be dismissed based on how the law reads. He still doesn’t have any income from those 18 years.

    In reality, this is case will be decided in family court, where laws are routinely ignored so as to give women as much power and money as possible, and where child support amounts are inflated so that the state gets its matching federal funds as per the Social Security Act.

    My prediction: she will win, despite the law being on his side.

    Indeed, what kind of monster serves up a lawsuit to a man who just got out of prison where he’s been unjustly for 18 years looking to grab the little bit of money he has to get on with his life?

    Sadly, this woman is not the exception but rather the norm in our culture. As KRS says, we don’t even have any confidence in “liars’ court” for basic administration of the law much less justice and fairness.

    (I’m going somewhere with this) In addition, as I love to point out to the discomforture of feminist apologists, women now have the right to abandon their children because so many children have been killed. So society now has absolutely NO standards of women to act decently.

    I’m reminded of a funny story about someone I knew in my hometown who was a brazen risk taker. He got some kind of adrenalin rush off of it. He decided to go on a shoplifting spree and went into the store and grabbed everything he could off of the shelves and stuff it into his jacket. He walks about with a big pot belly to the car and dumps it into the back seat.

    Then he said: “Oh, damn! I forgot to get batteries!” and went back in again for another run.

    He got nailed (well, almost) but the point of the story is that such brazen personalities don’t know their limits. I think they might have some kind of gray line and are experts at establishing it but as they get away with more and more, they lose control. Police say that’s how they catch these guys.

    I wonder if feminism and this mad anti-male chivalry is going the same route. As women become more and more awful, what happens when enough men wake up? How will the Denises and Sommers convince them to just tweak a few things? There’s no “mend it, not end it” solution here. We need serious, radical reformation of these systems.

    Did the mother have a child-support order in effect all those years? If so, how did they calculate the amounts owed. If he’s in jail and has no income, the amounts must be zero. Also, in criminal court, impossibility of complying with the law is a defense it seems like he could raise.

    Dwayne Allen Dail had the (mis)fortune of being born with a penis in a nation where anyone born with a penis is a fourth-class citizen, with diminished or no civil, criminal, social, and reproductive rights.

    After being sent to prison for 18 years of his life for an act of rape for which he was innocent, partially on the testimony of a 12-year-old girl…………..

    ……… now he faces having to share his poverty-level income of $20,000 per year for those miserable years in prison with yet one more greedy, self-centered American bitch!

    Here’s a man who stands to be raped at least twice in his life, once for a sexual assault that he never committed, and once again for back child support for those years during which he was wrongfully imprisoned, to benefit a greedy scumbag with a vagina (the key to extracting money from men through the power of the state).

    And who knows how many times Dail suffered from sexual assaults himself, while imprisoned……….

    You had better believe that the feminazis running Womyn’s Studies programs to indoctrinate young people with their propaganda and who tell their lurid “horror stories” about men to legislators to help press through more misandry-laden bills like VAWA and IMBRA will never mention Dail’s case aloud.

    Glenn Sacks, for all of his imperfections, does Mensnewsdaily readers a major favor for simply bringing cases such as this particular monumental travesty of justice to our attention.

    How many men are rotting in prisons for rapes that they never committed?

    And how much longer must men fear of being convicted for rapes that they did not commit…….. based on such a low level of credibility as a 12-year-old child’s testimony and hair similar to that found at the scene of the crime?

    A woman is denied a restraining order, her ex-husband kills her and the responsible judge is not only out of a job, he’s the target of a legal inquiry into his conduct.

    Yet a man is sent to prison for 18 years of his life for a rape that he did not commit, and there are no legal consequences for those responsible for sending him to prison.

    We threw out the British government for far, far lesser abuses than that.
