Child Support Suit Dropped Against Man Who Spent 18 Years in Prison for Crime He Didn’t Commit
Background: Dwayne Allen Dail, who was pardoned after spending 18 years behind bars for a rape he didn’t commit, was recently sued for back child support. Dail, 39, was cleared in August of the 1987 rape of a 12-year-old Goldsboro girl. The girl identified him as her attacker and hair found at the scene was similar to his. But DNA evidence found on a fragment of the girl’s nightgown years after the trial proved Dail wasn’t involved in the attack.
Dail will receive a chump change $360,000 from the state – $20,000 for each year he spent in prison. Upon his release he was served with a lawsuit by ex-girlfriend Lorraine Michaels, the mother of his son, who is seeking back child support. Dail said he was devastated by the suit, and that his son had recently moved to Florida to live with him. Goldsboro — A child support lawsuit for back child support against a Wayne County man who spent 18 years in prison for a crime he did not commit has been dropped.
Dwayne Dail said the suit, filed in November by his former girlfriend Lorraine Michaels for back child support while he was in prison, was dismissed Friday.
But he said he could not comment on the deal but was happy the matter was resolved.
“I am very happy and relieved to have this black cloud removed from me and my son’s bonding process,” Dail said. “And I hope that there can begin some healing between me and Lori, too. This has been extremely difficult for everyone involved.”
Michaels sued for a “reasonable sum” of a $360,000 compensatory payment Dail is due from the state for his wrongful imprisonment.
Earlier this month, a judge ruled Michaels should receive only a portion, if any, of the payment
Dail spent 18 years in prison for the rape of a 12-year-old girl. He was exonerated by DNA evidence in August.
He is expected to receive that by the end of January and said he plans to use it to buy a house for him and his son and enroll them both in college. Dail said he wants to pursue a career in criminal justice to help other innocent people in prison.
“I want to have that feeling of having helped someone who is desperately in need of help,” he said.

I am glad he is out of the State Gulag and the child support suit has been dropped.
However, it is a “crime” by the state to only compensate him with a measly $360K! We read almost every day about law suit settlements from spilt hot coffee to whatever totalling $MILLION$ but someone who has spend the better part of his life in the State Gulag hellhole for a crime he didn’t commit gets only a fraction of that? This is injustice on top of injustice.
An I just bet that a good bit of the $360,000 will go back to the government in the form of taxes too!

wonder what happened to the no forgiveness for back CS law? what about the mafia type interest and penalties, and fees? and is the state still entitled to federal matching funds? i predict there to be a suprise for him once the msm lights dim.
when insurance companies make payouts for compensation for losses there are no taxes on that money. But you’re right luek, past experiences w/ gov’t predict big % deduct for taxes, since the payout will come all in one year. should be interesting to monitor. the devil is most likely in the details here.

A classic case of life under feminist jurisprudence in America.
Offer an innocent man 3 years probation to plead guilty to something he didn’t do, then give him 2 life sentences plus 15 years if he doesn’t take the “deal”. Ask yourself if you would have taken the “deal”, even knowing that after serving 18 years in hell you would finally work your way through the maze of greed, bias, and corruption to finally be exonerated. If you are guilty or female, the judiciary is your friend. If you are innocent and male, you’re screwed.
Hide, conceal, and deny the existence of evidence that will exonerate him. Something very fishy is going on there, as I suspect “asking a second time” for the exculpatory evidence really means asking somebody who has no vested interest in concealing judicial and prosecutorial corruption. I suspect the story that a dead police investigator had it in his closet story is simply a coverup of another coverup.
The greedy mother’s “child support” lawyer is from the same law firm as the original prosecutor. Is that firm a group of “attorneys at law” or corrupt “feminazis at law”, and is there any difference nowadays.
At least the father and son are together now. There is certainly nothing unusual about a man and his son reuniting after 18 years of being separated while a greedy mother and some sleazy lawyers cash in.
Meanwhile the media is on the lookout for discrimation against women 24×7x365, and half the men in America don’t understand that the only difference between them and guys like Dwayne Dail is the whim of just one person with PC genitalia.

Very succinct DcFather. I wonder why I have not read your or similar comments in any msm editorials.
I won’t Monday morning quarterback Mr. Dail’s reasoning behind agreeing to keep this deal from public eyes, but the only way to change the current anti-male system is to expose every wrong taking place. But, even then who knows….not many in the msm had a problem with the Winkler murderer going free while Michael Vick does two years for killing a dog. Nothing wrong with this picture??

Something “fishy” is indeed going on ,the whole God awful greedy and corrupt legal system.
In all cases of injustice, like the one put on M. Dail, it almost always a case of lazyness, greed or just simple a hatred of men that causes it . Mr Dail need to go after those responsible for this injustice and make an example out of them. Puttin’ a few of these “government thugs” in jail just might prevent some other poor soul from being put through this hell. When you start making these bastards accountable, they start remember what their job is, JUSTICE, not personal gain. They then have a tendency to do the job correctly, knowing that if the persecute someone innocent , they won’t just walk away clean, they will answer for it!
The only reason I can think of that the terrorist in the “child support system” ( stifled laugh) backed off is that he has something on them. In my experiences with “government thugs” is that are arrogant to high heaven, only because they believe you can’t touch them! Now. if you can remove imunity or have some dirt on them, they, like the cowards they are back off and run away. The last thing they want to happen is for their little money making scheme to backfire and they end up on the receiving end. They know they would never last very long in prison.
Some lifer would make them pay the “ultimate penalty, a schanking the prison yard. ( they would deserve it and it would be righteous , fair and just)
