		<description>I&#039;m reminded of a story I heard from a former lawyer girlfriend back in California:

Apparently, a woman lived in a co-ed halfway house and got drunk and fell down the stairs and was unconscious.  The men (who aren&#039;t exactly LA&#039;s finest) decided to take advantage of the situation...

Ok, here&#039;s where it gets funny.  Yes, there is a funny side to this: It turns out that she was DEAD at the time but the men didn&#039;t know it.  They all had sex with an (albeit warm) CORPSE!!!

Here&#039;s the legal conundrum I would like to see verified.  According to her, the DA couldn&#039;t charge them with rape since she was dead and rape only would apply with a live person.  On the other hand, they couldn&#039;t be charged with necrophila since there was no intent for this act.  They were let go.  

A policeman commented to her (so she claims): I can sympathize.  I sometimes have a hard time telling if my wife is alive too.</description>

Nancy Grace threw her usual fit on television about the cold blooded nature of the act but our society doesn&#039;t reward men who do the right thing.

Look at Darren Mack: Here&#039;s a guy who tried to work in the system and he was told that he had to pay his wife most of his salary in alimony and other compensation for her &quot;sacrifice&quot; of marrying a rich man.  If he had killed himself, he would just be an anonymous statistic but since he wound up shooting his ex-wife and the corrupt judge, he&#039;s a national villan.  Either way, the system doesn&#039;t give men a lot of good choices.

In the meantime, nearly every state (48 out of 50) have &quot;legal infant abandonment&quot; laws to make it easy for women to abandon their babies legally to discourage them from murdering them despite a plethora of welfare and child-support measures for unwed mothers.  

Imagine what will happen when men just say to-hell-with-it and act with the same moral standards as women...</description>

Girls goes to a frat house and gets drunk (lets say .10) but isn&#039;t so drunk that she passes out.  She has sex with 2 frat brothers in front of 20 to 30 witnesses.  She goes back to her sorority house but later regrets it and claims she was raped.  Am I right in saying because she was drunk, that those frat brothers are guilty of rape?  Because if that&#039;s the case, I&#039;m going to need to buy a Breathalyzer.

Personally I followed a rule that said if she can&#039;t walk straight then it&#039;s a no go but this ruling is frightening.  Should we just videotape every sexual encounter now just to be safe?</description>
