		<description>I believe Thomas Jefferson was among the most vocal who saw the absolute foolishness in allowing the Supreme Court to be the final arbiter in deciding constitutionality. (Of course, as you pointed out, they didn&#039;t even cite this justification in Kennedy vs. Louisiana.) That power should never have been allowed to be in their hands, but rather in the hands of the congress, as mentally defective as it is.)</description>

The direction of the courts is disturbing. Equally disturbing is that it was Republican appointees that have lead the way for the Supreme Court to follow a  direction away from the Constitution. 5-4 is a very narrow margin when deciding on the citizens right to bear arms. Have these 4 justices really studied the U.S. Constitution?

Have the justices read the Geneva Convention? Do they know the requirements for &quot;soldiers&quot; and that terrorists fighting for an idealogy and not a country-terrorists without uniform-do not fall under the definition of &quot;soldier&quot; and therefore have no claim to rights as a soldier?

In Massachusetts, and now California, marriage has been replaced by a new meaning (thereby vanquishing the original meaning) by a right created from whole cloth-a right that exists nowhere.

The GOP has no spine-otherwise Ginsberg would have been &quot;Borked&quot;. 

The GOP will get slammed this fall. 

The only thing that can give conservatives any sense of hope is that the two justices likely to retire under an Obama administration are two liberal ones who will simply be replaced by two different liberal ones. Break even.

Un-surprising the GOP has again dropped the ball.
