They routinely violate the basic rights of parents,most notably fathers! I started studying the legal system 5 years ago,( oct 2003) and have made some amazing and deeply troubling discoverys! First, the family courts are courts of equity, they don't have to obey the constitution in any shape or form, suprize... surprize. Yea, anyone having anything to do with these corrupt bastards knows this! But what most people don't know and I had find out, is that this is their weakness. These courts of equity or more correctly, these "equity tribunals" operating under the colour of law, have to follow all the law,not just the parts they like! When these equity tribunals fail to follow all the law, ie due process, they lose something. That something is Subject Matter Jurisdiction. As I said, this is their weakness. The courts, as corrupt as they are, still have to follow the law and have ruled time and time again, a judgment of a court that was made where subject matter jurisdiction was lacking is a void and that judgment can be made to go away. This includes judgments for child support and child custody. Now you have to understand something, the courts interceded in these cases because someone, ie usually the mom, asked them to. The court operates in the belief that a family break down has occured, which is true. Now here is the rub, Once the courts authority has been removed, ie by the filing of the proper challenge and the courts must bow out if Subject Matter Jurisdiction is lacking. Because of due process rules, this cause of action cannot be refiled on, but the state and the courts themselves, can refile as a seperate action. The way to prevent this is to, sit mom down, propose a private arrangement, one where you still have to take responsibility for you children, but this arrangement will restore you status as a parent, ie the state cannot impose their biased and unfair requirements on you. Now you do have to follow the law, but the law in its pure form, minus the corruption of the legal system, is quite fair and equitable. And once mom, understands that she no longer has the upper hand, she acts better, but it only works if you do what is right and do it consistantly. You have to be more than a visitor and financial provider, although you will still do both. You have to demonstrate to mom and the courts, although they have been removed, that this arrangement works and the state and the courts have no cause of action to intercede and that if they do involve themselves again, they had better have followed the law to the letter and if they do so without that requirement, the feds will be getting involves. And the feds do follow the rules and will come down hard on state officials who violate the law and the rights of parents. Now if all this sound hard to do, yes, it is! But if you want the GiSKERS out of your business and you want you status as a parent back, and at present this the only thing that I have ever seen ,that actually works, this is what you have to do! This will only be a temporary fix, once the GiSKERS wise up and do follow the rules this loop hole will disappear. But there are millions of cases where they screwed up and it will take years for them to fix it. In the mean time, we tear these evil bastards down as much as we can. Taking money, power and control away from them is the only way to beat them. By the time they, clean up their act, this God awful racket will be gone. Civil rights laws will have been passed and enforced, this whole evil racket will be just some pages in a history book.
